Coaching Contract | Terms & Conditions

This contract, terms and conditions are designed to be a reliable, agreeable and mutually beneficial agreement between the coach and the client. This document sets out the contract, terms and conditions for providing professional money coaching services between: Eleena Katz, a Money Coach (hereby referred to as Coach) and the client (hereby referred to as the Client.) The Coach agrees to provide services to the Client as provided in this agreement.

SCOPE

Includes bi-weekly 45-minute coaching calls between the Coach and the Client over 6 months.

Unlimited Voxer access Monday – Friday – all replies expected within 24 hours excluding weekends

Coaching sessions will take place via video conferencing, and the Coach will send a link to the Client to join prior to the session time.

COACH RESPONSIBILITY

The Coach’s responsibility is to support, educate, and inspire the Client in achieving your goals and desired outcomes.

The Coach will work with you over 6 months to identify goals, limiting beliefs, and offer solutions and suggestions, including but not limited to creating a system for success that works for you. The Coach will advise based on their own personal experience, training and useful information.

This contract is in place for 12 weeks total. Within this time, the Coach is expected to provide everything outlined in the scope.

The Coach will also:
• Provide original, high quality services as requested by the client
• Treat the client with professionalism and courtesy at all times
• Respond to any communications within a reasonable timeframe
• Show up to coaching calls on-time unless prior notice has been given

CLIENT RESPONSIBILITY

The Client:

• Is solely and exclusively responsibile for all financial decisions made, and is responsible for any and all outcomes by implementing the advice and steps from the Coach.

• By signing this Coaching Agreement, agrees and acknowledges that the Coach is not a licensed investment advisor or financial planner, real estate agent, accountant, therapist, health or legal professional.

• Will be accountable, act upon the coaching, and do your part to make it a success and to accomplish your goals.
• Understand that the Coach is not liabile for any financial setbacks, other results, or non results that may occur from a

financial plan, information provided, or relationship with the coach.

The Client will also:
• Answer questions honestly asked by the coach
• Show up to coaching calls on-time unless prior notice has been given • Promptly pay fees as stated

FEES

The client agrees to make payment of $8,000 USD paid in full or $1,466 per month for 6 months to the Coach at the start of service, which covers the entirety of the work between the Coach and the Client as specified in the Scope.

OUT OF SCOPE

Anything that is not listed explicitely is not included. Any further services requested by the Client are subject to additional fees.

SCHEDULING

Client or Coach may, from time to time, need to cancel or reschedule a coaching session. If Coach is responsible for the reschedule, Coach will become available to Client as the soonest possible opportunity within 7 business days. If Client is responsible for the cancellation or reschedule, Client agrees to notify Coach no less than 24 hours prior to scheduled meeting.

CANCELLATION + REFUND POLICY

The Coach does not offer refunds. The Coach is here to coach the Client to their highest level of success, and part of that is requiring a commitment that they are fully invested in the transformation. It is to the Clients benefit to decide BEFORE purchasing a coaching program and committing to work with the Coach that they are the right coach for you.

CONFIDENTIALITY AGREEMENT

The Coach will not divulge that they are in a coaching relationship without the Client’s express consent. The Client, of course is free to discuss the coaching relationship with anyone at anytime. Any documents and supporting information that the Client provides to the Coach will be kept confidential. Any work created by the Coach that features the client’s information will be kept confidential unless permission from the Client allows otherwise. Due to the private nature of personal finance, no Client information will be made public without the Client’s permission.

INDEMNIFICATION

The Client Mary Mehan, agrees to hold the Coach Eleena Katz harmless for any such damages that may arise from the coaching work. In no event shall the Coach be liable for any direct, indirect, punitive, incidental, special consequential damages whatsoever arising out of or connected with the use or misuse of their work product.

The Coach assumes no responsibility for any special, incidental, indirect, or consequential damages of any kind, or any damages whatsoever (including without limitation, those resulting from her work product or from:

• loss of use, data, or profits
• user or client reliance on the materials or documents produced
• costs of replacement writings, training, or documents
• delays or business interruptions,
• and any theory of liability, arising out of or in connection with the use or performance of the Coach’s work whether or not

the Coach has been advised of the possibility of such damages.

FINAL ACCEPTANCE OF WORK

If both the Coach and the Client complete the coaching sessions to the satisfaction of each party, we will reach the final acceptance of work. After the final acceptance of work. the Coach will continue to keep the Client’s information private and the Coach will complete no new responsibility or work.

TERMINATION

This agreement will automatically terminate after the agreed upon amount of coaching sessions have been completed.

Either party may terminate the agreement prior to its natural expiration under certain circumstances. This agreement may be terminated in the event of a breach of the terms by either party. The agreement may also terminate upon the inability of the Coach to perform the services because of a sudden and medically-documented physical or mental disability. In this case only, a refund less the coaching time already spent will be issued. Termination may also be enacted by either party for any reason. Notice must be given prior to termination.
